1. SWEEPSTAKES OVERVIEW: The Sponsor of this Sweepstakes is CoxHealth (the “Sponsor”), a Missouri non-profit corporation, with its principal place of business located at 3850 S. National Ave., Suite 500, Springfield, MO 65807. Sponsor’s contracted agent, Mostly Serious, a Missouri limited liability company, with its principal place of business located at 4064 S. Lone Pine Ave., Springfield, MO (“Administrator”), shall be the administrator of the Sweepstakes.
2. ELIGIBILITY: The CoxHealth.com Sweepstakes (the “Sweepstakes”) is open to anyone who is at least 18 years old and resides in Southwest Missouri at the time of entry. “Southwest Missouri,” as referenced herein, shall mean the following Missouri counties: Barry, Barton, Camden, Christian, Dade, Dallas, Douglas, Greene, Hickory, Howell, Jasper, Laclede, Lawrence, McDonald, Newton, Ozark, Polk, Pulaski, Shannon, Stone, Taney, Texas, Vernon, Webster, and Wright. Void where prohibited. Unless otherwise specified, employees, agents, officers of the Sponsor and Administrator, and their respective affiliated companies, partners, and any entity which is involved in any aspect of the creation, production, operation, execution, or fulfillment of this Sweepstakes and their immediate families and those living in the same household, whether or not related, are not eligible to enter the Sweepstakes.

By obtaining an entry in the Sweepstakes, the entrant (“Entrant”) agrees to be bound by these Official Rules (“Official Rules”). The Sweepstakes is governed by these Official Rules and is subject to all applicable federal, state, and local laws. The Sponsor's interpretation and application of the Official Rules shall be final, and Entrants waive any right to challenge any decisions made by the Sponsor.

1. DURATION: The Sweepstakes begins Thursday, April 13, 2023, at 12:00 p.m. Central Time and ends Friday, April 28, 2023 at 5:00 p.m. Central Time (“Sweepstakes Entry Period”). Sponsor is the official timekeeper of the Sweepstakes. Entries received outside the Sweepstakes Entry Period will be ineligible and will be discarded.
2. HOW TO ENTER: During the Sweepstakes Entry Period, eligible individuals may enter the Sweepstakes by (1) going to www.surveymonkey.com/r/75DFWZK and completing the survey and entry form with all required information, including their name and email address; or (2) eligible individuals may participate without visiting www.coxhealth.com/sweepstakes, by hand-writing “CoxHealth.com Sweepstakes”, his/her complete name (no initials), valid e-mail address, telephone number and their home ZIP code on a 3½x5” card (“Mail-In Entry”) and mail it with sufficient postage to: CoxHealth, Attn: Marketing Department, 1550 E. Sunshine, Springfield, MO 65804. All Mail-In Entries must be received on or before April 28, 2023. Eligible individuals successfully entering the Sweepstakes in conformity with either method will be referred to as “Entrants”. By entering, Entrants are granting permission for their name, image, and likeness to be used on www.surveymonkey.com/r/75DFWZK and for other publicity and promotional purposes in conjunction with the Sweepstakes. Neither Sponsor nor their respective officers, directors, shareholders, employees, and agents are responsible for incorrect or inaccurate transcription of entry information. Entry materials that have been tampered with or altered are void.

Maximum one (1) entry per person during the Sweepstakes Entry Period, regardless of method of entry. There is no cost to enter the Sweepstakes and no purchase necessary in order to win.

If the name of more than one person is submitted with an Entry, and that Entry is selected as a winning Entry, then the person named first will be deemed the holder of record of that Entry and declared the potential winner. The Sponsor will not, and is not obligated to, assign the Prize(s) to any person other than the verified Prize winner(s). In the event of a dispute regarding the identity of any Entrant, the authorized account holder of the email address used to enter the Sweepstakes will be deemed to be the Entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider.

The use of multiple identities and/or accounts is prohibited, and any attempt to obtain more than the stated number of entries will void all of that Entrant’s entries and shall result in Entrant’s disqualification. Incomplete, forged, altered, automated, mechanically reproduced, lost, late, misdirected, garbled, or illegible entries, or entries that do not meet the size or formatting requirements specified above, will be disqualified.

Entrants further agree to not knowingly damage or cause interruption of the Sweepstakes and/or prevent others from using the Sweepstakes. Sponsor reserves the right to disqualify any individual it determines, in its sole discretion, has tampered or intends to tamper with the entry process or the operation of the Sweepstakes, or is acting in violation of these Official Rules. The use of robotic, automatic, macro, programmed, photocopied entries, or multiple entries sent in bulk mail, or like methods, including without limitation the use of any promotion/sweepstakes subscription, notification entry or like sites or services that offers sweepstakes entry services “on behalf of” Entrant, is strictly prohibited. Use of any automated system to participate is prohibited and will result in disqualification. No Entries or requests for Entries will be accepted from or on behalf of, corporations, trusts, partnerships, or other entities. Any attempt to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor will not be responsible for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware, or software, whether originating with sender, Sponsor, or Administrator.

Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes at any time for any reason.

1. WINNERS/PRIZES: Ten (10) winners will be randomly chosen on or about May 1, 2023 (each a “Winner”, collectively “Winners”), and each Winner will receive one (1) Amazon e-gift card worth one hundred dollars ($100) (“Prize”).

Winners will be notified by email after the Sweepstakes Entry Period. Odds of winning depend upon the number of eligible entries received. If the Sponsor is unable to reach a potential Winner via email within forty-eight (48) hours after the potential Winner is selected or if any message is not returned within twenty-four (24) hours, or if a potential Winner declines a Prize for any reason, then that potential winner will be disqualified, and, in such instances, will forfeit any claim to any of the Prize and Sponsor may, at its discretion, select an alternate potential Prize winner from all remaining valid Entries.

As a condition to eligibility to claim any Prize, a potential Winner may be required in Sponsor’s sole discretion to execute an affidavit of eligibility and any further liability waivers, or other documents required by Sponsor. Failure to submit any required documents within the time period specified by the Sponsor, or any other noncompliance with these Official Rules, may result in disqualification and Prize forfeiture.

The Winners of the Prizes authorize the Sponsor to report the award of the Prizes in accordance with applicable law. Sponsor will deliver Prizes to Winners by email to the email address provided by Winner in his or her Entry.

Sponsor reserves the right to substitute any Prize with another of equal or greater value. All state, federal, and local taxes or other expenses not specified herein are the sole responsibility of the Winners. Prizes are non-transferable and non-assignable unless otherwise agreed at Sponsor’s sole discretion.

LIMITATION OF LIABILITY; INDEMNIFICATION: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL ENTRANTS FOREVER RELEASE, HOLD HARMLESS, DISCHARGE, AND COVENANT NOT TO SUE SPONSOR, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, CONTRACTORS, VOLUNTEERS, SUCCESSORS AND ASSIGNS (COLLECTIVELY “RELEASED PARTIES”) FOR AND FROM ANY AND ALL CLAIMS, DEBTS, LIABILITIES, DEMANDS, OBLIGATIONS, COSTS, FEES, EXPENSES, ACTIONS, CAUSES OF ACTION WHATSOEVER, OF EVERY NATURE, CHARACTER AND DESCRIPTION (COLLECTIVELY, “CLAIMS”), KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY RELATED TO THE SWEEPSTAKES; THESE OFFICIAL RULES; ENTRANT’S ENTRY; THE NEGLIGENCE OF ANY OF THE RELEASED PARTIES; AND THE ACCEPTANCE, POSSESSION, MISUSE OR USE OF ANY PRIZE.

THE WINNER AGREES TO INDEMNIFY AND HOLD THE RELEASED PARTIES HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND ARISING FROM, IN CONNECTION WITH, OR AS A RESULT OF PARTICIPATING IN THE SWEEPSTAKES OR THE WINNER'S ACCEPTANCE OR USE OF THE PRIZE.

IN ADDITION, EACH ENTRANT ACKNOWLEDGES AND AGREES THAT THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR ANY COSTS, INJURIES, LOSSES, OR DAMAGES OF ANY KIND ARISING FROM OR IN CONNECTION WITH: (I) INCOMPLETE, LOST, LATE, MISDIRECTED OR ILLEGIBLE ENTRIES OR FOR FAILURE TO RECEIVE OR PROCESS ENTRIES DUE TO ANY CAUSE, INCLUDING WITHOUT LIMITATION, HUMAN, TRANSMISSION, OR TECHNICAL PROBLEMS, FAILURES, OR MALFUNCTIONS OF ANY KIND, WHETHER ORIGINATING WITH SENDER OR OTHERWISE, THAT MAY LIMIT AN ENTRANT’S ABILITY TO PARTICIPATE IN THE SWEEPSTAKES; OR (II) ANY INJURY OR DAMAGE RESULTING FROM PARTICIPATION IN THE SWEEPSTAKES AND/OR THE USE OR MISUSE OF A PRIZE (INCLUDING, WITHOUT LIMITATION, CLAIMS, COSTS, INJURIES, LOSSES AND DAMAGES RELATED TO PERSONAL INJURIES, DEATH, DAMAGE TO, LOSS OR DESTRUCTION OF PROPERTY, OR ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES RELATED TO OR BASED ON THE ENTRANT’S RIGHTS OF PUBLICITY OR PRIVACY, OR THE ENTRANT’S CLAIM THAT HE OR SHE HAS SOMEHOW BEEN DEFAMED OR PORTRAYED IN A FALSE LIGHT.) ENTRANT REPRESENTS AND WARRANTS THAT HE OR SHE OWNS AND/OR HAS THE AUTHORITY TO RELEASE THE CLAIMS STATED HEREIN.

The Prize(s) will be transferred to the Prize winner(s) "AS IS, WHERE IS, AND WITH ALL FAULTS." THE RELEASED PARTIES DO NOT PROVIDE ANY GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, IN CONNECTION WITH THE PRIZE OR PRIZES AND ACCEPTS NO LIABILITY OR RESPONSIBILITY REGARDING THE CONSTRUCTION OR CONDITION OF THE PRIZE OR PRIZES. THE RELEASED PARTIES DO NOT WARRANT THAT THE PRIZE OR PRIZES ARE OF MERCHANTABLE QUALITY OR THAT THEY CAN BE USED FOR ANY PARTICULAR PURPOSE. NO EXPRESS WARRANTIES ARE GIVEN AND NO AFFIRMATION OF THE RELEASED PARTIES BY WORDS AND/OR ACTIONS WILL CONSTITUTE A WARRANTY. PRIZES CANNOT BE TRANSFERRED, SOLD, SUBSTITUTED, OR REDEEMED FOR CASH BY THE WINNER(S). THE SPONSOR RESERVES THE RIGHT TO SUBSTITUTE A PRIZE OF COMPARABLE OR GREATER VALUE IN THE SPONSOR’S SOLE DISCRETION.

PUBLICITY: By participating in the Sweepstakes, each Entrant irrevocably grants the Released Parties the right to use each such Entrant’s name, hometown, photograph, testimonial, image, video, or other likeness and/or Prize information or personal exposition (and/or any edited portion thereof) and any written or oral comments about the Sweepstakes or Prizes in any and all media and form for any purpose, including, without limitation, advertising, publicity, and promotional purposes, now or hereafter known, throughout the world in perpetuity, without compensation or notice to, or further consent of, the Entrant, to the extent permitted by law. Each Entrant hereby releases the Released Parties from any liability with respect thereto, except where prohibited. By entering this Sweepstakes, Entrant permits the Released Parties to utilize Entrant’s contact information provided by Entrant to contact Entrant for any reason via phone, email, and/or mail.
2. SOCIAL MEDIA DISCLOSURE: Although this promotion may be advertised on the Facebook pages, Twitter accounts, Instagram accounts or other social media platforms of Sponsor or another, this promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or other social media platforms. Participants are providing their information to the Sponsor and not to Facebook, Twitter, Instagram or other social media platforms. The information a Participant provides will only be used by the Sponsor. By entering, Participants provide a complete release of Facebook, Twitter or Instagram from any and all responsibilities implied or provided by the Sponsor and that this promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or Instagram.
3. WAIVER: The Sponsor’s delay or failure to enforce any term or provision of these Official Rules shall not constitute a waiver of that provision.
4. GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the Entrants, Sponsor, or Released Parties in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the state of Missouri without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.
5. DISPUTE RESOLUTION: Except where prohibited by law, as a condition of participating in this Sweepstakes, each Entrant agrees that (1) any and all disputes and causes of action arising out of or connected with these Sweepstakes, including but not limited to Prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) (pursuant to its expedited procedures) and held at the AAA regional office nearest Springfield, Missouri; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will any Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, including attorneys’ fees, other than Entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased.
